Assumption of Risk, Release & Waiver

Please read this page in full before you book. You will be asked to agree to it when you book.
You will also be asked to complete WorldSprings' own guest waiver when you check in on the day. That is a separate document, between you and the venue, and it covers their facilities. This one is between you and The Gilded Collective and covers the retreat we host. Both are required.
1. What the day involves
A Gilded Collective retreat may include soaking in heated mineral pools, exposure to high heat in saunas, cold-water plunging, walking on wet and uneven surfaces, time outdoors in Texas weather, food and drink, group activities, and — depending on your package — massage or other treatments provided by venue staff.
2. Risks you are accepting
These activities carry real risks that cannot be eliminated, including but not limited to: slipping and falling; overheating, dehydration, fainting or heat exhaustion; cold shock or hypothermia from cold plunging; cardiovascular strain; drowning or near-drowning; skin or eye irritation from mineral water; allergic reactions to food, drink or products used in treatments; soreness, bruising or injury from massage; sunburn; and exposure to communicable illness. Risks are higher if you are pregnant, have heart or blood-pressure conditions, diabetes, epilepsy, are taking certain medications, or have consumed alcohol.
3. Your confirmation about your own health
By booking you confirm that you are 18 or over; that you have considered whether these activities are appropriate for you and taken medical advice if you were unsure; that you will tell us before the event about any pregnancy, medical condition, injury, allergy or medication that could affect your safety; and that you will stop and seek help if you feel unwell on the day.
4. Following instructions
You agree to follow the venue's rules and the reasonable instructions of our hosts and venue staff, including limits on how long to stay in hot or cold water, and not to enter the water while impaired.
5. The venue is independent
WorldSprings is a separate business with its own terms, rules and guest waiver, which you will be asked to complete on arrival. Treatments such as massage are provided by the venue's own licensed practitioners under the venue's terms, not by us. Nothing in this document limits or replaces the venue's own waiver, and nothing in the venue's waiver limits or replaces this one.
6. Release
To the fullest extent permitted by Texas law, you knowingly and voluntarily assume all risks of participating, and you release, waive and discharge The Gilded Collective d/b/a The Gilded Collective, and its owners, officers, employees, hosts, contractors and volunteers, from any and all claims, demands and causes of action for personal injury, illness, death, or loss of or damage to property arising out of or relating to your attendance at or participation in the retreat.
This release expressly includes claims arising from the ordinary negligence of the released parties. It does not release any claim for gross negligence, intentional misconduct, or any liability that cannot lawfully be released under Texas law.
This waiver should be reviewed and adapted by a Texas attorney before public launch, especially because Texas law has specific requirements for releases of negligence claims.
7. Emergency care
If you are injured or become unwell, you consent to us or venue staff arranging emergency medical care, and you accept responsibility for the cost of that care and any transport.
8. Emergency contact
Please give us an emergency contact name and number at checkout or by email before the retreat.
9. If you do not agree
Please do not book. Email us instead and we will talk it through, or refund a booking you have already made if you tell us before the retreat.
